reagarding H1B

Hi Vasu
I am working in Hyd on .net .I am planning to come to US and my cousin is helping me .What i need to know is if i apply now through normal processing for 2005 quota will my application approved with in the time.
I am very tense here.please give me the information becuz already my cousin is submitted papers to lawyer and they are going to file in this week.

Hi Maha,

General processing takes around 2 and half months time to get H1 papers.

Premium processing takes around 2 to 3 weeks time to get H1 papers.

Check with your cousin when he is giving your H1 start date.

If your cousin applies your H1 by giving start date as Oct 1st 2004, i am not sure whether it is safe or not, becoz by Oct 1st 2004 you will get not H1 papers. even if you get H1 papers, you will not get appointment before Oct 1st 2004. Becoz till August ending the appointments are not there as it is full.

If you have plan to come on Oct 1st 2004, ask you cousin to apply for premium processing if possible, with Oct 1st start date.

If you have plan to come in Feb 1st 2004, general processing is fine with H1 start date as Nov 1st 2004. For general processing, if 3 months difference is there between applying date and start date, that will be good.

Dont get tensed. ok .

Your H1 application will be approved.
You will get Visa.
You will enter into USA

another question is that if starting date is october 1st within how many months we have to enter into US.

Dont think in other way becuz i do not have idea about all these thing

Theoretically, USCIS may never get back to you regarding your Work Visa application. This is not to scare you! But, honestly, if you were to delay your entry by telling a client/employer that you will join work at this date and you keep postponing it, your employer may either cancel your application or terminate your appointment.

I presume that you will be joining a consulting company. Therefore, the above scenario may not apply to you!

My dear friend Vasu, meant to say that the \"date of employment\" in your application should preferably reflect a date which is 3 months from the date you actually applied for a H1B Work Visa. Since the quota resets and visa processing starts from Oct.1st 2004 and assuming that your Visa application is processed in Nov.2004, your \"likely joining date\" would have been sometime in February 2005 since it takes atleast 3 months for the processing, security checks and documentation.

My observation is that, regardless of when your \"employment start date\" is, you shouldn\'t be bothered about USCIS processing your application based on that date!

Unless you have a solid job offer from a direct-employer and not a consulting company, AND if you absolutely have to join the company in the Month of October 2004, then Vasu recommends that your application be filed with a \"Premium Processing\" status. Under this scheme, you will receive a decision within 15 days stating whether your application was approved or not!

My observation is that - just because your H1B I-197 is approved, you still have to get stamping and then come here before you are officially authorized to stay here by the Visa Officer at the Port of Entry! So, getting your H1B approved is only taking one step forward.

Hi Maha,

If I am in your situation I will prefer Normal Processing. Since this will take you 2 to 3 months. It means if you apply in the month of August you will get the papers by Nov.

One more is now the Visa date are not available with TTS. and lot of people are applied and got approved H1 papers and it will over crowded in the month of October and November. So, by the time you receive your papers it may be some what free. And the chances of geting Visa will also be more since Christmas comes in this month and the visa rejection rate for the month of Dec is less than any other month.
