Question reg I140 application during GC process

Hi,
I am trying for my GC through future employment. I approcahed this employer long back. Initially he said i have an approved labor and we will file for I140 and 485 simultaneously, then he said we will file I140 first and then once we get the EAC number we will file for 485 with that receipt number.

After some time he said we got EAC number.

Now all of a sudden he is saying INS has sent back my whole file stating that they need to transfer the labor to my name by the Labor Dept.
What he says is since the labor is on someone else name they need to fill another application on my name and enclose that labor and send it to labor dept and they will authorize it and send it back in max 3 weeks.

But i am not convinced.

Does INS really send back a file asking to go to labor dept again r am i getting cheated here.

He made me fill 750B form and send it to him.

I paid him full money upfront, in case if he is cheating me is there any way that i can get back my money.

So far he didn\'t send me any document.

There is a very high probability that you got caught in a Pre-Approved Labor Scam. Did you pay anything to the Consulting Firm which advertised like that? Also, INS is not stupid in the sense that if a whole name is different from that of the I-140, they are not going to send it back and request a change in name. That is total BS. Nonetheless, you have the right to sue your firm and there is a very high probability that the firm will be shut down forever if the right authorities are informed.
